1. Who we are
These terms apply to services provided by Titus Original ("we", "us") to you ("you", "the customer").
Titus Original is the trading name of Titus Florin Belciu, a sole trader. Business address: 3 Wyllen Close, London E1 4HQ.
Contact: hello@titusoriginal.co.uk.
2. Who these terms are for
Our services are for businesses only. By agreeing to these terms you confirm that you are buying for the purposes of your trade, business or profession (for example as a sole trader, partnership or company), and not as a private individual.
Nothing in these terms takes away legal rights you have that can't be excluded.
3. What you are buying
You buy the services set out in a written contract that you sign before work starts: either one of the packages on our Pricing page or a personalised quote. The package description, or the quote, sets the scope. Anything outside it is extra work (see section 7).
4. Prices
Prices are shown on the Pricing page. Any additional cost outside a package is explained and agreed with you before the work is carried out. Where a cost can't reasonably be worked out in advance, we explain that an additional charge may apply and how it will be calculated.
Prices are final: Titus Original is not VAT registered, so no VAT is added. A written quote stays valid for 30 days.
5. Payment
For website projects (Business Website, Website Redesign and Landing Page), 50% is paid to start the project and 50% is paid before the website launches.
Other one-off services (such as Social Media Starter, Profile Refresh, Online Presence Check, and email, domain and hosting setup) are agreed in a written contract and paid in full before work starts.
Monthly services are paid monthly, in advance.
You can pay by bank transfer or PayPal. Invoices are due within 7 days.
If an invoice is paid late, we may pause work, and any monthly service, until the overdue amount is paid. Business customers may also be charged statutory interest and fixed compensation for late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Changes and revisions
Website packages include 2 rounds of reasonable changes. Reasonable changes are things like text changes, image changes, colour changes, small layout adjustments and corrections to information. Social Media Starter includes 1 round of changes. Monthly services include the number of requested changes shown on the Pricing page.
A "round" is one consolidated set of feedback: all the changes you want, sent together in one message or list. Changes sent in separate pieces count as separate rounds, so please review everything before you send it.
7. Extra pages, features and additional work
New pages, major redesigns, new systems, new features or substantial additional work are outside the package. We quote them separately, in writing, and only carry them out once you have agreed the price. An additional website page is priced on the Pricing page.
8. Domain, hosting, email and other services
- Domain. Up to £15 of the first-year domain cost is included with a Business Website or Landing Page, and with Domain Setup. If your chosen domain costs more, you pay only the difference. The domain is registered for you and belongs to you.
- Hosting. First-year hosting is included when you use our recommended hosting. If you choose another provider, that provider's hosting cost is paid separately. We aim to handle the setup while keeping your ownership clear.
- Email. Business Email Setup includes the first-year email subscription up to £100. If the service you choose costs more for the first year, you pay the difference.
- After the first year. Domain, hosting and email services may need renewing. We will tell you the current renewal cost before renewal. Your domain stays yours.
- Third-party services. Domains, hosting, email and similar services are supplied by other companies, and their own terms and prices apply to them. We choose services that suit your needs, and we will tell you which ones we use.
9. Your responsibilities
You are responsible for giving us the content, images and business information we need, and for making sure it is accurate. You confirm that you have the right to use everything you give us, including text, photographs, logos and other material. Please tell us if anything you give us belongs to someone else.
10. Photography
You can provide your own photographs and images. Professional photography can also be arranged through our photographer partner. It is discussed and agreed separately, and is not part of a package price.
11. Timing and delays
Delivery time is agreed with you before we start. It depends on the project and on how quickly you provide the information and feedback we need. If information or feedback is missing or late, the agreed dates may move.
If a project is waiting on information or feedback from you for more than 30 days, we may pause it. Restarting then depends on our availability, and the agreed dates will move.
12. Launch and 30-day support
We launch your website once you have approved it and the payment due before launch has been made. After launch, 30 days of support covers problems with the website we built. It doesn't include unlimited new work, new pages, new features or major redesigns. Those are quoted separately.
13. Monthly services and maintenance
Website Care, Social Media Management and Website + Social Care are ongoing monthly services. What each includes is listed on the Pricing page, and anything beyond it is quoted separately.
There is no minimum term. You can stop a monthly service at any time by emailing us, and it ends at the end of the month you have already paid for.
14. Cancellation, termination and refunds
You can ask to cancel a project or service at any time by emailing us. Nothing here removes any legal right to cancel or to a refund that you have by law.
Projects. Before you have signed the contract, you can cancel at no cost. Once the contract is signed, cancelling costs a cancellation fee of £75, or the price of the service if that is lower. If work has already started, you also pay a fair amount for the work done up to that point, based on the stage reached. We refund any part of what you have paid that is more than the cancellation fee plus the fair amount for work done.
Monthly services. These can be stopped at any time, with no cancellation fee, as described in section 13.
If our work isn't done with reasonable care and skill, we will put it right. That doesn't limit any rights you have by law.
15. Ownership and intellectual property
Your domain, and your content, images and business information, belong to you. You own the accounts registered in your name.
Once you have paid in full, you own your finished website: its design, text and images. We keep ownership of our own general tools, templates and reusable code, and give you a licence to use them as part of your website.
We don't use third-party photographs, graphics, logos, fonts or other material without the right to do so.
16. Showing your project in our portfolio
We will ask your permission before showing your project publicly, for example on our Work page. Concept projects on our website are made by us to demonstrate our work. They aren't client projects.
17. Liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that the law doesn't allow us to limit.
For any other loss, our total liability to you for a project is limited to the amount you paid us for that project. For a monthly service, it is limited to the fees you paid for that service in the previous 12 months.
We aren't responsible for problems caused by third-party services outside our control, such as an outage at a hosting or email provider, beyond what the law requires of us.
18. Complaints
If something isn't right, please email hello@titusoriginal.co.uk and tell us what happened. We will look into it and reply.
We aim to reply to complaints within 10 working days.
19. Governing law
These terms, and any dispute about them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
20. Changes to these terms
If we change these terms we will update the date at the top. The terms that applied when you agreed a project continue to apply to that project.
